AREAS OF PRACTICE CONSTRUCTION LIABILITY
In Texas and the southwest a building boom has occurred over the last ten years. Unfortunately, many areas (particularly Dallas) have had some of the highest construction accident injury and fatality rates in the country. Our firm has helped numerous victims and families of victims that have suffered injury or lost a loved one due to the unsafe practices of construction companies or other employers. Whether the injury involves a fall, a dangerous activity, a misused piece of equipment or unsafe work-site practices, we have the experience and ability to investigate and pursue these oftentimes difficult cases and assist in recovering adequate compensation.
Some of our recent recoveries include:
 (a) L____: A construction company was running behind schedule in El Paso, Texas. In an effort to make up time, the company failed to take adequate safety steps while preparing to dig a trench in an alley. As a result of this conduct, a worker fell into an undiscovered basement rendering him a paraplegic. While working with a prior law firm, Clay helped the victim and his family secure a $6,000,000.00** settlement. ** A contigent (%) fee charged on the successful recovery resulted in a fee of $2,400,000.00 and $120,000.00 in litigation expenses which were reimbursed by the client out of the gross settlement amount.
(b) D____: Our client was a 26-year-old, unmarried illegal alien working as a laborer for a roofing contractor in a North Texas apartment complex project. The contractor failed to provide basic fall protection to our client and his co workers. As a result, our client fell three stories, leading to injuries that took his life. After an intense legal battle, our firm secured a $1,000,000.00** settlement for the laborer's father, a Mexican citizen, on the eve of trial. ** A contigent (%) fee charged on the successful recovery resulted in a fee of $400,000.00 and $24,800.00 in litigation expenses which were reimbursed by the client out of the gross settlement amount.
(c) M____: Our client was sent to work on a roof at a retail construction project in Oklahoma City. Unbeknownst to our client, an hour earlier, multiple holes had been cut in the metal roof, but no guarding was placed around the cuts. When our client stepped on the edge of the roof, the roof became a trapdoor and he fell, causing multiple fractures. A suit against the general contractor was settled for $900,000.00**.
** A contigent (%) fee charged on the successful recovery resulted in a fee of $360,000.00 and $31,900.00 in litigation expenses which were reimbursed by the client out of the gross settlement amount.
